Welcome to HomeBod, an AI-powered fitness and wellness mobile application (the "App") developed and operated by SilverAI ("we," "us," "our," or "HomeBod").
By downloading, installing, accessing, or using the HomeBod App or any of our services, you agree to be legally bound by these Terms of Use ("Terms"). If you do not agree to these Terms, you may not use the App or our services.
Please read these Terms carefully, along with our Privacy Policy, before using the App.
1. Definitions
- "App" means the HomeBod mobile application.
- "Services" means all features, content, and functionality offered through the App, including AI Body Scanning, workout plans, progress tracking, and related services.
- "User," "You," "Your" refers to any individual or entity that downloads, accesses, or uses the App.
- "Content" means all text, graphics, images, videos, audio, code, and software available on or through the App.
2. Acceptance of Terms
By using the HomeBod App, you represent and warrant that:
- You are at least 18 years of age or have the permission of a parent or legal guardian.
- You have the legal capacity to enter into a binding agreement.
- You will comply with all applicable laws and regulations.
- All information you provide is accurate, current, and complete.
3. Registration and Account
To access certain features of the App, you may be required to create an account. You agree to:
- Provide accurate, current, and complete registration information.
- Maintain and promptly update your account information.
- Keep your password secure and confidential.
- Notify us immediately of any unauthorized use of your account.
- Be responsible for all activities that occur under your account.
We reserve the right to suspend or terminate your account if any information provided is inaccurate, false, or violates these Terms.
4. License to Use the App
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:
- Download and install the App on a compatible mobile device you own or control.
- Use the App solely for your personal, non-commercial purposes.
You may NOT:
- Copy, modify, distribute, sell, or lease any part of the App.
- Reverse engineer, decompile, or attempt to extract the source code of the App.
- Use the App for any illegal or unauthorized purpose.
- Remove, alter, or obscure any copyright, trademark, or other proprietary rights notices.
5. AI Body Scanning and Camera Access
HomeBod uses AI Body Scanning technology that requires access to your device's camera to provide posture correction and rep counting features. By using this feature, you acknowledge and agree that:
- Camera images and video are processed in real-time on your device and are not stored on our servers unless you explicitly choose to save them.
- You are using the feature in a safe environment with adequate space and proper lighting.
- You grant HomeBod permission to access your camera for workout analysis purposes.
- You understand that AI analysis may not be 100% accurate and should use your own judgment when performing exercises.
6. Subscription and Payment
HomeBod may offer both free and paid subscription plans. If you purchase a subscription:
- Billing: Subscriptions are billed in advance on a recurring basis (monthly, annually, etc.).
- Auto-Renewal: Your subscription will automatically renew unless you cancel it before the renewal date.
- Cancellation: You may cancel your subscription at any time through your device's app store settings or the App.
- Refunds: All payments are non-refundable unless required by law or specified in our refund policy.
- Price Changes: We reserve the right to change subscription prices with advance notice.
7. Health and Medical Disclaimer
IMPORTANT: Please read this section carefully.
- HomeBod is a fitness app and is not a substitute for professional medical advice, diagnosis, or treatment.
- Before starting any exercise program, consult with a qualified healthcare provider, especially if you have pre-existing health conditions.
- Always listen to your body. Stop exercising immediately if you experience pain, dizziness, or discomfort.
- HomeBod and SilverAI are not liable for any injuries, health issues, or damages resulting from your use of the App.
- The App's AI analysis and recommendations are for informational purposes only and should not be considered medical or professional fitness advice.
8. User Conduct
You agree NOT to:
- Use the App for any unlawful purpose or in violation of these Terms.
- Upload or transmit viruses, malware, or any harmful code.
- Harass, threaten, or harm other users.
- Attempt to gain unauthorized access to the App, servers, or networks.
- Use bots, scripts, or automated tools to access the App.
- Share your account credentials with others.
9. Intellectual Property Rights
All Content, features, and functionality of the App are owned by SilverAI or its licensors and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
Trademarks: "HomeBod," the HomeBod logo, and all related names, logos, and slogans are trademarks or registered trademarks of SilverAI. You may not use these marks without our prior written permission.
10. User-Generated Content
If you upload, post, or share any content (such as workout videos, comments, or feedback) through the App, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display that content for the purpose of operating and improving the App.
You represent that you own or have the necessary rights to any content you submit and that it does not violate any third-party rights or applicable laws.
11. Privacy and Data Protection
Your use of the App is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the App, you consent to the collection and use of your data as described in the Privacy Policy.
12. Third-Party Services and Links
The App may integrate with or contain links to third-party services (such as Apple Health, Google Fit, or payment processors). We are not responsible for the content, privacy practices, or terms of use of any third-party services.
Your use of third-party services is at your own risk and subject to their respective terms and conditions.
13. Disclaimer of Warranties
The App is provided "as is" and "as available" without warranties of any kind, either express or implied.
We do not warrant that:
- The App will be uninterrupted, secure, or error-free.
- The results obtained from using the App will be accurate or reliable.
- Any errors or defects will be corrected.
14. Limitation of Liability
To the maximum extent permitted by law, SilverAI, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Personal injury or property damage
- Loss of profits, data, or goodwill
- Service interruptions
- Any other damages arising from your use of the App
Our total liability to you for any claims arising from your use of the App shall not exceed the amount you paid to us in the 12 months preceding the claim.
15. Indemnification
You agree to indemnify, defend, and hold harmless HomeBod, SilverAI, and our affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your violation of these Terms
- Your use or misuse of the App
- Your violation of any rights of another person or entity
- Your breach of any applicable laws or regulations
16. Termination
We reserve the right to suspend or terminate your access to the App at any time, with or without notice, for any reason, including but not limited to:
- Violation of these Terms
- Fraudulent or illegal activity
- Non-payment of subscription fees
- Prolonged inactivity
Upon termination, your right to use the App will immediately cease. Termination does not relieve you of any obligations incurred prior to termination.
17. Changes to These Terms
We reserve the right to modify or update these Terms at any time. When we make changes, we will update the "Last Updated" date at the top of this page and notify you via email or through the App. Your continued use of the App after changes are made constitutes your acceptance of the revised Terms.
18. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of Vietnam, without regard to its conflict of law principles.
Any disputes arising from these Terms or your use of the App shall be resolved through:
- Negotiation: We encourage you to contact us first to resolve any issues informally.
- Arbitration: If informal resolution fails, disputes shall be resolved through binding arbitration in accordance with the rules of the Vietnam International Arbitration Centre (VIAC).
